Man handing a police officer his license during a DUI traffic stop

You’ve been taken into custody for allegedly driving under the influence (DUI), and now you’re worried about how this will impact your life moving forward. If you are facing a DUI charge in San Diego, it’s important to work with an experienced DUI lawyer who will represent your best interests.

A DUI case can involve a criminal court case and a separate DMV hearing regarding your license. The case may raise questions about the police report, video footage, breath or blood testing, the officer’s observations, and whether the stop or arrest was lawful.

As a DUI attorney in San Diego with whom clients work directly, I can help you review the evidence to better understand the case against you and decide how to respond.

Why Should You Hire a DUI Lawyer in San Diego?

On the surface, a DUI in San Diego may seem like a minor criminal offense. However, this is far from the truth. Although DUIs are among the most common criminal offenses, a DUI remains one of today’s most complex types of criminal cases to properly defend. In addition, a DUI case’s stakes are higher in the long term when compared with the stakes associated with many other crimes.

California’s system and legal standards for DUI cases are technical and evidence-driven, and a DUI lawyer in San Diego can help you navigate each part.

What Happens After a DUI Arrest?

There are several things that can happen after a DUI arrest. You may receive a court date and paperwork from the arresting agency. The DMV may send you notices about your driving privileges.

It’s important to follow deadlines for anything you receive, as the DMV process is separate from the criminal case.

Some of the additional next steps may include:

  • Reviewing the citation, release paperwork, and court date
  • Requesting a DMV hearing within the required deadline
  • Looking at whether a temporary license or driving restriction applies
  • Reviewing police reports, testing records, and video evidence
  • Preparing for the first criminal court appearance
  • Discussing whether the case involves aggravating factors

A San Diego DUI defense lawyer can help you start reviewing these issues before your first court date. Contact me to talk about your situation.

Criminal Court and DMV Hearings

Many people do not realize that a DUI case can involve both criminal court and a DMV hearing.

The court case deals with the criminal charge, while the DMV hearing addresses driving privileges and possible license suspension.

It’s important to treat both separately, as the result of one doesn’t necessarily control the other.

In a criminal case, the prosecution may look at evidence like:

  • The reason for the traffic stop
  • The officer’s observations
  • Field sobriety test notes
  • Statements made during the stop
  • Breath or blood test results
  • Dash camera or body camera footage
  • Prior DUI history, if any

The DMV process is typically more focused on whether the agency has grounds to suspend or restrict your driving privileges. Because the hearing request deadline is short, you should not wait to ask your San Diego DUI lawyer questions after an arrest.

Breath Test and Blood Test Evidence

Chemical testing is often a major part of a DUI case, but the test result does not determine the outcome alone. Breath and blood test evidence can raise questions about timing, collection, calibration, maintenance, storage, chain of custody, and whether lawful procedures were followed.

As a DUI lawyer, I may look at questions such as:

  • Was the testing device properly maintained or calibrated?
  • Was the sample collected correctly?
  • Was there a delay between driving and testing?
  • Were the officer’s observations consistent with the test result?

From my many years as a San Diego DUI attorney, I know just how important it is to look at the entire timeline.

Traffic Stop and Arrest Challenges

The test result isn’t necessarily the most important part of the DUI defense. Sometimes the most important questions are why the officer stopped the vehicle at all, what the officer claimed to observe, whether there was enough information to continue the investigation, or whether the arrest was supported by the facts.

As a DUI lawyer in San Diego, it’s my job to review whether law enforcement followed the rules during a stop, investigation, and arrest.

First and Subsequent DUI Charges

The first DUI in California is typically charged as a misdemeanor. The court may give you requirements depending on the facts of the case. Those may include:

  • Probation
  • Fines
  • DUI education
  • License suspension

Cases are treated more seriously if they involve:

  • Prior DUI convictions
  • Collisions
  • Injury allegations
  • A very high BAC allegation
  • Refusal issues
  • Excessive speed
  • A child passenger

Some prosecutors may also consider felony charges.

The important thing is that you don’t assume the outcome based only on whether this is your first case or whether anyone was hurt. DUI cases are fact-specific, and your San Diego DUI attorney can look at how those facts may work in your favor.

Frequently Asked Questions About DUIs

While it all depends on the facts of the case, some of the most common defenses include:

  • You were not under the influence, or your BAC was under 0.08%
  • The stop was not made with probable cause
  • The checkpoint was unconstitutional
  • There were other explanations for your faulty driving
  • Faulty testing or inaccurate field sobriety testing

If you’re facing a DUI charge, your San Diego DUI lawyer will review all aspects of your case and prepare to challenge any part of it as needed.

Penalties can vary for a DUI charge in California. Judges will sometimes choose to order probation and are more lenient for first-time offenders, depending on the case’s specific allegations. Fees may be incurred up to $1,000 for a first-time DUI, though this can increase depending on other penalty assessments brought forward.

You may have your license suspended, and the length for which it’s suspended can depend on whether this is your first, second, or third charge.

The prosecution and the judge may also add penalties if you have prior DUI convictions, you were allegedly speeding while intoxicated, or your actions caused an accident or bodily harm to another person. These are considered aggravated DUI factors and may also escalate your charge to a felony.

Likewise, additional punishments may be handed down if you had children in your car with you at the time of the DUI arrest, or if your blood alcohol level was .15% or above, which is considered a high blood alcohol content level (BAC) DUI.

It may be easier to achieve a less severe penalty and avoid jail time by hiring an experienced San Diego DUI lawyer who can help you understand what options may be available. Call me to talk about your case.

I was dealing with a very malicious neighbor who filed baseless lawsuits as harassment to cover up their illegal construction. Michael sucessfully defeated them in court; and was also able to get them to pay my attorney fees, thereby detering further baseless lawsuits. Michael is unique in that he will work with his clients to devise feasible and successful court strategies, is affordable, is unassuming. and gets back to you when you have a question, unlike other attorneys. Michael also has a lot of experience since he spent many years as a deputy district attorney and in private practice dealing with a wide variety of civil and criminal cases. He knows his way around a court room. I was very satisfied with his representation and highly recommend Michael MacNeil if you need smart, effective representation.

It was rough, but Mr. MacNeil gave me reassurance that everything would work out through communication and helping me understand this whole process. He's very honest, fair, and goes above and beyond for his clients. His communication is ON POINT! I was worry-free throughout majority of this process. BTW... I was not paid or begged to write this review. He's just that awesome in my opinion.
